Terms of Service

These Terms of Service ("Terms") govern your access to and use of BuildPlan Pro (the "Service"), provided by AFK Artifact Co ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Account

You must be at least 18 years old, or have authority to bind your organization, to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it current.

2. The Service

BuildPlan Pro is a construction project planning and scheduling tool for builders and their teams. We grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with the plan you have selected.

3. Acceptable Use

You must not, and must not allow anyone else to:

• Use the Service for unlawful, fraudulent, or harmful purposes;
• Send spam, malware, or other malicious content;
• Infringe the intellectual property or privacy rights of others;
• Probe, scan, scrape, or interfere with the security or integrity of the Service;
• Reverse engineer, decompile, or attempt to derive the source code of the Service;
• Resell or redistribute the Service or circumvent any plan limits.

4. Intellectual Property

AFK Artifact Co retains all right, title, and interest in and to the Service, including all software, documentation, designs, and branding. You retain ownership of the content you upload ("Your Content"), and grant us a limited license to host, process, and display Your Content solely to provide the Service to you.

5. Payment, Billing & Subscriptions

Payments are securely processed by Stripe. By subscribing, you also agree to Stripe's terms applicable to your purchase. We do not store full card numbers or other sensitive payment credentials on our servers.

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account's billing portal; access continues until the end of the current paid period. New accounts include a 14-day free trial that does not require a payment method.

6. Refunds

Refunds are described in our Refund Policy.

7. Service Availability

We work hard to keep the Service reliable, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. We may modify or discontinue features with reasonable notice.

8. Warranties & Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. BuildPlan Pro is a planning tool — you are responsible for verifying schedules, dependencies, and safety-critical decisions on your jobsite.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold AFK Artifact Co harmless from any claims arising out of Your Content, your use of the Service in violation of these Terms, or your violation of applicable law.

11. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. Upon termination, your right to use the Service ends; we will make Your Content available for export for a reasonable period before deletion.

12. Changes to the Service or Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. The state and federal courts located in Texas will have exclusive jurisdiction over any disputes arising from these Terms or the Service.

14. Miscellaneous

You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for failures caused by events beyond reasonable control (force majeure). If any provision is held unenforceable, the remainder will remain in effect.
